# Terms of Use for MyPicker

These Terms of Use ("Terms") apply to MyPicker, an iPhone app provided by Michel Sfeir ("MyPicker," "we," "us," or "our").

## 1. License

MyPicker is licensed to you, not sold, under Apple's [Licensed Application End User License Agreement](https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) (the "Standard EULA"). These Terms add details about MyPicker. If these Terms and the Standard EULA conflict, the Standard EULA governs.

## 2. Free Features and the One-Time Unlock

MyPicker is free to download. Without a purchase, you can import or capture photos, pick colors, save picks, copy color values, delete colors, and see your newest nine colors in Library.

**Unlock MyPicker** is a one-time, non-consumable in-app purchase. It is not a subscription and never renews. It unlocks:

- **Colors**: editing and conversion in multiple formats, with color maps and harmonies;
- **Compare**: up to four colors side by side, with contrast checks;
- Suggested palettes found in your photos;
- Picking from any moment of Live Photos and animated images;
- Your whole Library, with favorites, albums, and tags; and
- Export and Backup & Restore.

The unlock belongs to the Apple Account that bought it. You can use **Restore Purchase** to activate it on your other devices or after reinstalling. If Family Sharing is enabled for the purchase, members of your family group can use it under Apple's Family Sharing terms.

Colors saved before you unlock are never deleted by the free limit. Older colors stay on your device and appear when you unlock.

## 3. Payment, Refunds, and Your Statutory Rights

Apple processes all payments, in the price shown in the App Store for your country or region, including any applicable taxes. Refund requests are handled by Apple, for example through [reportaproblem.apple.com](https://reportaproblem.apple.com). If Apple refunds or revokes a purchase, the unlocked features become locked again; your colors are not deleted.

Nothing in these Terms limits the rights you have under the mandatory consumer laws of your country, including any right of withdrawal or legal guarantee of conformity for digital content.

## 4. Color Values Are as Recorded in the Image

MyPicker reports the color recorded in a digital image. That color depends on the camera, lighting, processing, file format, and color profile, and it may differ from the physical object's color. Displays also vary.

- MyPicker does not provide calibrated measurement of physical colors.
- CMYK values are approximate. Accurate print colors require a profile for your printer and paper.
- Contrast checks use the WCAG 2 contrast formula as a guide. They do not on their own guarantee that a design meets accessibility law or guidelines.

Please verify colors with appropriate tools before relying on them for professional, commercial, safety, or medical decisions.

## 5. Your Content

Photos you import and colors you save remain yours. MyPicker processes them on your device and does not upload them (see the [Privacy Policy](privacy.html)). You are responsible for having the right to use the images you import and the files you share.

You are responsible for keeping your own backups. Local storage cannot protect against loss of a device, removal of the App, or failures outside MyPicker's control.

## 6. Acceptable Use

You agree not to circumvent, disable, or interfere with MyPicker's purchase verification, or to copy, modify, reverse engineer, or redistribute the App, except as the Standard EULA or applicable law expressly permits.

## 7. Updates and Availability

We may update MyPicker to add, change, or remove features, fix problems, or follow Apple's requirements. We will not take away features covered by the unlock from people who bought it, except where required by law, by Apple, or for security reasons. MyPicker needs a compatible iPhone and iOS version.

## 8. Disclaimer and Liability

MyPicker is provided under the warranty and liability terms of the Standard EULA. To the extent permitted by law, MyPicker is provided "as is." Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

## 9. Changes to These Terms

We may update these Terms when MyPicker or the law changes. The updated Terms will be published at this address with a revised effective date. Changes do not take away a purchase you have already made.
